THE SOCIETY REGISTRATION ACT 1860 :
It was the years 1860 in India when the British Empire has incorporated the Society Registration Act. On the 21st May 1860, this act came into force to encourage society related organizations in India. Although this act was made in the British Period, it is still maintained post independence era in India.
WHAT IS CALLED A SOCIETY? :
Society is an association of the general public who join together by mutual agreement to serve some common purpose. This type of organizations are formed to endorse different philanthropic activities in the field of education, wellbeing, arts, culture, sports, music and many more.
Requirements for a Society :
You need to take some necessary steps in order to create a Society. Then you can apply for the Society Registration Process. To form a Society, you need to know these below mentioned information.
Minimum 7 adult persons require forming a Society. The person can be an Indian or a foreigner, Company or other type of foreign society. Society Registration is maintained by the State Governments. So you
need to submit your documents and forms along with the fees to your respective state government authority.
Name Selection :
Before you file a name for your Society, you need to make sure that there is no other societies exist with that name. Even similar names would not be accepted by the government authority.
And the Society name shall not include any emblem or name regarding the Government of India or the State. No authorities of the Government provide patronage to such societies.
Filing for the Memorandum of Association :
The Society Memorandum of Association should be signed by all its members, and the same should be approved by Chartered Accountants, Notary public, Gazette Officer, Oath Commissioner, First Class Magistrate with their
official address and stamp.
The Memorandum must include the Society Name, details of the Members (name, address, occupation and designation), Purpose of the Society. And therefore you need to submit these below mentioned documents
to the respective authority for Registration process.
- Cover letter of Registration duly signed by all the established members.
- The Secretary or the President of the Society must provide an affidavit that declares the accords with the benefactors of the same.
- Certified and duplicate copy of the Memorandum of Association.
- A carbon copy of the Societies rules and regulations, signed by the established members.
- Annual List of the managing body.
- Some documents that can convey about the meeting for the Society Registration among the members.
